Terms of Service
Last updated: November 1, 2026
These terms apply to your use of this website and to the services of EMC TRUCK ROAD ASSIST LLC ("EMC"). By using the site or ordering a service, you agree to them.
1. Website information
The content of this site is for general information. It describes the services we offer and is not a quote or a guarantee of availability, arrival time or outcome.
2. Requests, quotes and authorization
Sending the form or calling us does not create a contract. Work begins when you approve the quote or work order.
Diagnoses, quotes and arrival times are estimates. If additional work is found during the repair, we will tell you and ask for your approval before doing it.
Service call, travel or diagnostic fees may apply; you will be told before the service is performed.
3. Payment
Payment is due as agreed on the quote or invoice, using the accepted payment methods. Unpaid work and parts may be subject to the rights Texas law grants to repair providers.
4. Parts and warranties
New parts carry the warranty of their manufacturer or supplier. Any labor warranty is stated in writing on the work order or invoice.
Warranties do not cover damage from misuse, accidents, lack of maintenance, customer-supplied parts or repairs made by others.
5. ECM programming and emissions systems
We only perform programming, updates and parameter changes permitted by law. We do not remove, disable or alter emissions control systems (DPF, EGR, SCR/DEF or others), or install software for that purpose, in accordance with the U.S. Clean Air Act.
Remote programming requires the customer to have the equipment, connection and licenses we specify. The customer must keep the vehicle safe, parked and stationary during programming.
6. Roadside service and safety
In an emergency or accident, call 911 first. We may refuse or stop work at a location that is not safe.
The customer is responsible for giving an accurate location and for being authorized to have us work on the vehicle.
7. Trademarks
Peterbilt, Kenworth, Freightliner, International, Mack, Ford and other names are trademarks of their respective owners. EMC is an independent provider, not affiliated with or authorized by them.
8. Limitation of liability
To the extent permitted by law, EMC is not liable for indirect damages, lost income, downtime, cargo or fines resulting from a vehicle failure or from delays. Our total liability will not exceed the amount paid for the service in question.
9. Governing law
These terms are governed by the laws of the State of Texas. Any dispute will be handled in the courts of Jefferson County, Texas.
